Attorney says Detroit’s threat to end liquor sales if dancers don’t cover up is all-out war

Detroit –Detroit may soon deliver an ultimatum to its strip clubs: Cover up or no booze.

The City Council on Wednesday is set to weigh a broad crackdown that would ban alcohol at clubs with topless dancing. The new rules also would stop lap dancing, close VIP rooms and force dancers to wear opaque pasties — even at dry clubs.

The rules are certain to reignite debate over the city’s 31 topless bars, and owners are vowing a fight.

“The city of Detroit has now decided they want an all-out war,” said Michael Donaldson, an attorney for All Stars and the Penthouse Club. “They cannot win. They are being totally stupid.”

But city staffers point to state and national court cases that support the legality of an alcohol ban. Richard Mack, an attorney and member of Perfecting Church, said the city must reject its status as Michigan’s strip club capital and home to 31 of the state’s 81 topless bars.

“Our goal is to do all we can within the law to root them out,” Mack said. “We don’t want the city of Detroit to be the dumping ground for lascivious behavior.”

The crackdown stems from a court battle in which a federal judge in 2007 struck down Detroit’s regulations on where clubs could open and ordered them rewritten. City staffers have recast the laws, but they have added tougher restrictions elsewhere — such as the alcohol ban. Pastors and community leaders have pushed for the changes and persuaded the council to get advice from Scott Bergthold, a Tennessee attorney who has worked nationwide to shut clubs down.

Here are some of the proposed changes:

• Alcohol can’t be served at any existing or new topless clubs. Once the City Council passes the change, existing clubs would have until their license expires, which is renewed every year, or the anniversary of the date the law was passed, to comply. A Michigan Liquor Control Commission official said Monday it’s up to the city to set those restrictions on the liquor licenses.

• Dancers would have to be 6 feet from patrons and on a stage at all times. A stage must be at least 18 inches off the floor in a room of at least 600 feet. That requirement likely would stop clubs from letting customers interact with dancers in smaller rooms, often called VIP areas.

• Dancers would also have to wear pasties..

Several council members did not return calls Monday on whether they would support the proposals. And Mayor Dave Bing’s staff said he hasn’t seen the proposals.

Rob Katzman, owner of the Toy Chest Bar and Grille, said the potential changes would put nearly all of the clubs out of business.

“You could not operate,” said Katzman, who argued that most clubs cause no problems. “You just wonder what the motivation is.”

But Mack argued the clubs lower property values and increase crime.

“Whenever they want to do their dirt, they come into the city and then return to their white picket-fenced suburban communities,” Mack said. “We want the same white picket-fenced communities.”

U.S. District Judge Julian Cook ordered the city to rewrite its rules, finding they gave city officials too much power to deny new clubs and didn’t address how long they had to act on applications. Under the old rules, clubs had to meet 15 broad criteria — including claims they wouldn’t reduce nearby property values — before the city signed on.

Cook ordered the city to revise its rules “forthwith.”

But the city has repeatedly delayed doing so. All the while, the council and mayor’s office have frozen transfers of liquor licenses that would allow clubs to open. The city is facing at least five recent federal lawsuits over its laws governing adult businesses.

CU student aims to open topless cafe in Boulder

Boulder’s Dan Kennedy wants to open a coffee shop — but instead of competing with the likes of Starbucks by offering specialty drinks, he wants to steam up basic coffee and pre-packaged pastries with topless waitresses.

He’s looking to open a shop in August, one day a week in the morning.

Kennedy — who said he will be a sophomore at the University of Colorado in the fall after transferring from Whitman College in Washington — has placed ads on Craigslist for bouncers and women willing to work topless, saying he’s interviewing three women and three potential bouncers Friday. He’s offering to pay the women $80 to $100 for a morning.

But he said he’s still researching the steps he needs to make the cafe legal. He also needs a location. His ideal spot would be a conference room at CU, though he’s also looking on University Hill.

By offering only drip coffee and prepackaged food, he said, “There’s no license and no regulations.”

But, CU spokesman Bronson Hilliard said, there are strict regulations governing businesses on campus — plus a student code of conduct that would prohibit operating an adult business at the university.

He said students can rent conference rooms for “normal campus activities,” such as study groups. Bottom line, he said, a topless coffee shop “is not going to be allowed.”

“This is a half-baked idea,” he said.

Kennedy said CU students are a big part of his target audience, and he’s considering charging a $12 cover fee to avoid attracting a crowd just looking to ogle the waitresses.

His job listing for the bouncer says the employee “will be checking IDs to make sure they are 18 plus. Making sure topless girls feel safe and no inappropriate behavior from customers.”

He acknowledged that some people likely will object to his risque business venture.

“It’s probably going to cause a pretty big stir,” he said.

A controversial topless coffee shop in a rural Maine town drew national attention — and was burned down in June by an arsonist after just four months in business. Before the fire, the owner had received 150 applications for 10 positions.

Locally, a strip club off the Pearl Street Mall that opened in late 2007 drew concerns from zoning and building-code officials soon after it opened. The city recently looked into ways to regulate adult businesses before they opened, but the Boulder City Council has yet to agree to any changes.

The city’s options include using zoning rules to limit where such establishments could open. Some cities, for example, forbid strip clubs from doing business within 1,500 feet of a church, school, child-care center, park or other adults-only venue.

The city could decide to issue licenses to strip clubs instead, a process that could resemble the way liquor licenses are handed out now.

Mayor Matt Appelbaum said it may be worth looking at the zoning regulations and giving the community a chance to offer feedback.

“Our regulations don’t really preclude these businesses,” he said. “There clearly are locations where they are not appropriate.”

City Councilwoman Susan Osborne said she doesn’t want the council to spend time on the issue, adding that she hasn’t seen much of a market for strip clubs and similar adult businesses in Boulder.

“There are so many big things going on right now,” she said. “This would just be a distraction.”

Safeco Fields raunchy new neighbor, a strip club, prevails in court

Strip clubs are back in the headlines, and they add to the cringe factor of an adult-entertainment venue opening up for lap dances next to Safeco Field, the home of the Seattle Mariners.

SEATTLE’S sleazy experience with strip clubs stirs genuine indignation at the prospects of one these degrading establishments opening so close to Safeco Field.

Last week, a King County Superior Court judge announced he could find nothing in the law or in the city of Seattle’s interpretation and application of land-use regulations to stop City Hall from issuing a business permit to Roger Forbes for a strip club in the Sodo area on First Avenue South.

Judge John Erlick worked with the law and facts before him, and his 11-page analysis indicates he was looking for mistakes, overstepping and sloppy use of words. He found none. The Seattle City Council had not used early opportunities to add stadiums — spectator-sports facilities — to the list of land uses and activities that could pre-empt or exile adult entertainment from a neighborhood.

Strip clubs in Seattle are as likely to be viewed as ersatz brothels as they are dingy gathering places for lonely men to sip overpriced soft drinks and ogle the female form. Lap dancing is prostitution by another name.

Law-enforcement issues with strip clubs have a long history, and the headlines are never dormant for long. Check out the latest round of indictments surrounding four clubs that federal charges conclude were no more than whorehouses.

Slimy dealings between strip-club associates and members of the City Council gave the community a political and campaign-finance scandal — memorialized as Strippergate — that yielded guilty pleas, stunted careers and smeared reputations.

Such is the legacy of the sex industry that will be the Mariners’ new neighbor. Baseball fans, young and old, are not going to be pleased to see the neon signs and ads promoting amateur night or the special appearance of a porn star.

The business is degrading to women. These are not victimless enterprises. Promoting base and destructive attitudes toward women is hardly a desirable welcome mat so near a signature, public-gathering place.

Is this a moralistic harangue? Yes it is. Is there a place for adult entertainment in a community? The courts all say so. Next door to Safeco Field is not the place. Somewhere in Sodo might be appropriate, but this establishment is too damn close to families and a general public that is insulted and offended by the intrusion.

Las Vegas Strip Club Bust Results in 13 Arrests

A major bust at a local adult strip club has resulted in 13 dancers being arrested for soliciting prostitution. Police allege the dancers were doing much more than dancing.

Metro made the arrests early Monday morning. Police say busts like this, are not uncommon, but the number of arrests is what makes this one stand out.

“It’s a pretty substantial. I don’t know how many particular entertainers were working in that establishment that night but 13 is a lot of folks,” said Lieutenant Karen Hughes, Metro.

All of the female dancers were arrested for soliciting prostitution. Police say it is now up to them to post bail or wait 48 hours to make a court appearance and be released.

Hughes works with Metro’s vice squad, and would not go into detail about how the arrests were made, but says this is part of her team’s job.

“They’re out there every night, working street operations, hotel operations, book stores, anywhere where people that come to Las Vegas are going to go to find something that’s just off the radar.”

Right now, Metro says Deja Vu management is not facing any charges.

“They will check to make sure there are not any key employees who are involved in those acts, because if that’s the case, then the license will be in jeopardy.”

Deja Vu’s General Manager Bob Proden says this is the first time a bust of this size has happened in the club’s 15 year history. He says the club has received dance code violations in the past but those were eventually dropped.

Strip clubs vow to fight Burl. City restrictions

Attorney Daniel R. Aaronson said the ordinance is an attempt by the city to put the strip clubs out of business. He said the ordinance violates the First Amendment and will not stand up in court.
At a City Council meeting last night at which a vote was originally scheduled, Aaronson said the strip clubs will sue the city if the ordinance is approved.
“This is not a threat,” he said. “It is a fact. It is a promise … We will fight back.”
The council postponed the vote on the ordinance from last night until next month, but several council members voiced their support for it.
The ordinance was proposed by the Police Department. Detective Joseph Caruso last night explained to the council why the department believes the ordinance is necessary.
“There is more crime at sexually oriented businesses than any other business in Burlington City,” he said.
Caruso said police responded to 164 calls to one sexually oriented business in the past two years. He said those calls include sexual assault, aggravated assault, carjacking and robbery.
Caruso said police have cited many people for urinating in public outside the strip clubs, and have been called to one club after members of the Crips gang were spotted there.
He said an investigation of a go-go bar in August found evidence of prostitution, drug use and drug dealing. In another investigation in September, Caruso said two dancers solicited undercover police officers for sex. He said the dancers offered to have sex with the men in private dance rooms.
Lawyers for the two strip clubs in the city, Club Risque and the Playhouse, deny that strip clubs increase crime, and said they are prepared to fight the ordinance.
Aaronson, of Fort Lauderdale, Fla., was hired by both clubs. He told the council that strip clubs do not reduce the value of neighboring properties, and in some cases actually increase property values.
He denied that strip clubs cause blight or spread sexually transmitted diseases.
He said the city will spend at least $250,000 in legal fees to fight a lawsuit. He urged the council to table the ordinance and talk with the strip club owners to reach a compromise.

The Playhouse hired a second attorney, Patricia Ronayne of Mount Laurel. Ronayne told the council that the Playhouse has been a part of Burlington City since 1988.
“They have not been a burden on this community,” she said. “They have not been a problem.”
She said the city does not have the right to tell the strip clubs how to decorate their businesses, such as restricting lighting or private booths.
“This is a fight we are confident we will win in Superior Court,” she said. “This is going to be struck down …”
“This ordinance violates the First Amendment. Nude dancing is a protected right, whether we like it or not.”
City attorney Anthony Val-enti changed some wording in the ordinance at last night’s meeting. Valenti recommended the city readvertise the ordinance before a final vote. The council scheduled that vote for its next meeting Nov. 9.
Several council members spoke in support of the ordinance. Councilman Edward Canivan said the city is not trying to put strip clubs out of business, but instead is asking them to “conduct their business out in the open.”
Canivan said the city must regain control of sexually oriented businesses. “We are here to provide a quality of life and safety for our residents,” he said.
Councilwoman Helen Hatala said she will vote in favor of the ordinance. “I feel that this ordinance is long overdue,” she said.
Some residents urged the council to approve the ordinance. One resident, a neighbor of a strip club, said she has seen people urinating outside the club and her grandchildren find used condoms on the ground.
There are six sexually oriented businesses in Burlington City, police have said.
The ordinance would require all of them to do away with private viewing rooms or dance rooms, and would permit police to inspect at any time during operating hours. The ordinance would require each business to obtain a city-issued license and pay an annual $1,000 fee.

Strip-club owner’s trial starts Monday

EL PASO — After five years of legal wrangling, a 66-year-old businesswoman is to stand trial Monday on charges that she prostituted dancers at her now-defunct El Paso strip club.
Jeannie Coutta is charged with promotion of prostitution and four counts of engaging in organized criminal activity.
Coutta and her business partner, Phyllis Woodall, were arrested in 2004 after a 14-month police investigation of their Naked Harem club at 6345 Alameda.
Police began the investigation because of allegations that minors were working as strippers at the club. This led to Coutta, Woodall and two of the club’s managers being charged in the prostitution case.
A jury in 2006 convicted Woodall, 52, of engaging in organized criminal activity and aggravated promotion of prostitution. She was sentenced to 16 years in prison.
In a 2005 court affidavit, police said two 15-year-old girls and a 17-year-old girl worked as a strippers at the club and were paid to perform sexual acts on customers in the club’s VIP rooms.
During Woodall’s trial, dancer Mari Snider, who worked at the club for six months in 2003, testified that Woodall said sex was not allowed in the club. But, Snider said, another dancer told her that sex for pay was allowed if dancers were willing.
A former El Paso County sheriff’s deputy, Ramon Alvarez, testified that he had frequented the club for years and paid for sex several times. He said he stopped going to the club after he learned of the police investigation. In
an interview last year, Coutta said she and Woodall were “set up” by employees who hired underage girls.
Jurors for Coutta’s trial were chosen Friday. Opening statements will begin at 7:30 a.m. Monday before District Judge David Guaderrama in 243rd District Court.
The two club managers arrested in the prostitution case, Maria Brooks, 53, and Sandra Zepeda, 44, are awaiting trial. Brooks’ trial is scheduled to begin Sept. 22. Zepeda’s trial date is still pending. Adriana M. Chávez may be reached at achavez@elpasotimes.com;

A lineup of loose-lipped lap dancers from what cops call a $20,000-a-night Midtown brothel has put the screws to their husband-and-wife bosses.

A Manhattan judge yesterday refused to toss the case against Louis and Betty Posner, former proprietors of the raided and padlocked Hot Lap Dance Club on West 38th Street — crediting, in part, accounts the much-more-than-strippers gave grand jurors.

“Big Lou,” or “Daddy,” as he was called at the club, must now face felony pimping and money-laundering charges — even though he had argued he had no idea prostitution was occurring at the club.

Meanwhile, his wife is still on the hook for charges of falsifying records, including listing the business in bank forms as “catering.”

Included in the ladies’ vivid testimony, according to new court papers:

* Louis Posner regularly booked himself as a customer in his own joint — with records indicating “no charge” or “comp.”

* He referred to condoms as “bubble gum” and made them available to the dancers.

* Posner often boasted that he had inside police sources — “contacts” who never came through in time for the July 2008 raid.

Canton Inn Shuts Down

A Gentlemen’s Club has closed its doors after the Department of Justice says prostitution was taking place inside.

“It’s no longer going to be the Canton Inn in Seaford as we know it,” said Representative David Short of Seaford.

Delaware’s Department of Justice says plenty of illegal activity happened behind closed doors.

“Undercover agents went in there and a dancer would come up to them and say ‘I will perform a sexual act on you in exchange for money,’” said Deputy Attorney General Philip Bangle.

The State says because of an undercover investigation the Canton Inn closed.

The gentlemen’s club was closed under Delaware’s Nuisance Abatement Law, which means that charges could either be brought forth or the owner could close the establishment. The Department of Justice says Owner David K. Lui chose to close its doors.

Bangle said, “This is an act we’ve been using over the last couple years to deal with properties that are havens for crime.”

The Club posed a threat to the public’s health, safety and welfare, according to the state. And Representative Daniel Short agrees.

He said, “A lot of citizens in the community didn’t want to see it there to begin with. It was close to a housing development across the street, there have been complaints of its existance.”

Lui could not be reached for comment. The State says the criminal charges against Lui have been dropped, but a civil lawsuit is now pending

The Coliseum is an above average gentleman’s club across the board, if a little pricey. It’s seriously state of the art, they have premium liquor, and the women are hot from the strippers right through to the service staff. It’s a casual strip club (the only dress code is a collared shirt) and even the bouncers are chill, a definite rarity at most strip clubs. Like we said though, bring extra cash, all this doesn’t come for free.

Cover Girls

You have to love a strip club with a free buffet and, if they’re still doing it, dollar pitchers on Sundays. Cover Girls has beautiful women, good drinks and your typical strip club atmosphere. Oh, and if you’re nearby on a Tuesday you have to drop in, Cover Girls host the best amateur night in the state.

Crazy Horse Detroit

What can you say about the Crazy Horse Detroit? Well, we can say plenty, but most of it probably wouldn’t be printed here. However, we will say that this adult club is top notch, with beautiful live nude dancers and reasonably priced booze and, hey, you have to love a gentleman’s club that opens early during baseball season.

Hard Body Cafe

The Hard Body Cafe Detroit is a no-frills adult club, meaning there’s no food to interfere with the live entertainment and consumption of libations. Come on, do you really go to strip clubs for the food? In case you’re stumped, the answer is no.

Hot Tamales

When you’re looking for strip clubs in Detroit, a huge red flag should go up when you contemplate Hot Tamales because nothing else will. Seriously, this strip club needs some major work. The drinks are okay, but if the best thing you can say about a strip club is that the drinks are okay, there is something wrong. We would liken this to an old strippers home, if there were such a thing.

La Chambre Lounge

We have it on good authority that La Chambre Lounge is one of Detroit’s best strip clubs. An unpretentious adult club, La Chambre is kicked back, casual and always a good time. The ladies are decent, the liquor is cheaper than most clubs, and the pricing structure for cover charge and lap dances beats out any other gentleman’s clubs.

Platinum

Easily one of the best strip clubs in Detroit, Platinum has simply gorgeous women,almost all of them black, a sick DJ that helps them shake their natural assets, and a liquor selection that shames most other strip clubs. The atmosphere is totally kicked back, comfortable, and the service from the staff is impeccable.

The Player’s Lounge redefines the term “gentleman’s club.” It’s a very upscale venue, serving fine cuisine, a well rounded wine list, a fine selection of cigars, and reasonably priced drinks. Oh, yeah, they also have some of Detroit’s hottest women dancing live for your viewing pleasure. Not a rowdy strip club by any stretch of the imagination, so leave your adolescent inner self at home.

Silk Stockings

Silk Stockings is among a handful of fully nude strip clubs in Detroit, which in layman’s terms means no booze. But, the women are fine and the pricing is comparable to other adult clubs and, hey, they’re fully nude. Drink someplace else.

Subi’s Place

Subi’s Place has been catering to Detroit’s adult club needs since 1971, so you know with a running history like that it has to be good. Some of the hottest girls of any strip club we’ve seen and, oh what variety, it’s like being a kid in some adult candy store. The drinks flows freely and they also offer lunch and dinner, but we believe that after you see the ladies, food will be the last thing on your mind.

Toy Chest

We’d say that the Toy Chest is probably the most fun strip club in Detroit. You’re encouraged to let a little of you’re wild side out which separates the Toy Chest from most other gentleman’s clubs, we mean you still have to respect the rules of the road, as it were, but have fun, that’s what strip clubs are for. Also, the Toy Chest, has phenomenal women with some national stars rolling through when they’re in Detroit.

Trumpp’s

Seriously, you can feel like the Donald himself at Trumpp’s. This gentleman’s club is upscale and they really do accommodate your every need. Good drinks, covered. Fine dining, covered. Cigars, covered. Beautiful ladies, uncovered. Anyway that is the whole point of a strip club, getting taken care of while watching some hotties.

Tycoon’s

Tycoon’s is a good place, but not in the upper echelon so far as Detroit strip clubs go. The drinks are good and the prices are right, but the entertainment could improve. If the cabbie takes you here, tell him to keep driving there are better adult clubs out there, find them.

Council Concerned New Rules Go Too Far

DETROIT — Strip club owners and dancers showed up in downtown Detroit Wednesday to protest rule changes for strip clubs.

The new rules would put some distance between strippers and customers and ban alcohol consumption inside the clubs.

Detroit City Council took up the new rules during a meeting Wednesday afternoon.

Strip Club Owners Don’t Want New Rules

The city has about 30 topless bars. If the new rules are approved, topless dancers would remain six feet from the patrons and on a stage at all times. There would also be no lap dancing and no mingling in so-called VIP rooms.

The proposed changes follow a court battle in which a federal judge in 2007 struck down Detroit’s regulations on where strip clubs could open and ordered them rewritten.

The rule that concerned council members the most was no alcohol inside the strip clubs.

“The two just go hand and hand. It’s like a casino. Is anyone going to go to a casino that doesn’t serve alcohol? Is anyone going to go to a sports bar to watch the Red Wings or the Pistons and not want to have a beer? Come on,” said Ken Cockrel Jr., Detroit City Council President.

Club owners said the rule changes would put them out of business.

The council has been under intense pressure from church groups to crack down on the clubs. Thirty-one of them are now licensed to operate in the city and that is about 40 percent of the total for the entire state.

The city is already facing lawsuits for refusing to transfer some club licenses. Council member Sheila Cockrel fears more litigation. “I’m not voting for any of these because it’s constitutionally protected behavior even if I think it’s disgusting,” said Cockrel.

The new rules would also keep new strip clubs 1,000 feet away from schools, churches or other strip clubs.

Strip Club owners appeared happy after the meeting because it appears the council members think the new rules go too far, but the issue still has a long way to go before a final decision is made on the rules.
